10-Year Workmanship Warranty
Warranty Is Contingent Upon Full Payment
This warranty is provided at the time of sale but becomes effective only if all amounts due under the roofing contract, including materials, labor, change orders, and the final contract balance, are paid in full no later than the day the roofing material is installed, as required by the roofing contract. If payment is not made as required, this workmanship warranty does not become effective.
What This Warranty Covers
Provided the payment requirements above are satisfied, Top That Roofing warrants the roof against leaks caused by Top That Roofing's workmanship for 10 years from the date the roofing material is installed. If our workmanship causes the roof to leak during the warranty period, we will repair the covered workmanship at no charge.
This warranty covers Top That Roofing workmanship only. Defective roofing materials are handled under the applicable manufacturer's warranty.
How to Make a Warranty Claim
Contact Top That Roofing within a reasonable time after discovering a suspected leak and allow us reasonable access to inspect it.
The homeowner should take reasonable and safe steps to prevent additional damage. You are not expected to climb onto the roof or perform unsafe work.
If the leak is caused by covered Top That Roofing workmanship, there is no charge for the inspection or covered repair.
Non-Warranty Service Calls
Sometimes a suspected roof leak is actually caused by another part of the home.
If our inspection determines that the leak, moisture, or other problem is not caused by Top That Roofing workmanship, the following service-call fee will apply:
- $195 within 60 miles of our office
- $300 more than 60 miles of our office
Any additional non-warranty diagnostic work or repairs will be discussed and authorized separately.
Dispute Resolution
If any dispute arises regarding the quality of the installation, the parties agree that:
- 1. The roofing manufacturer shall determine whether the product was installed per their specifications.
- 2. The manufacturer's written assessment shall serve as the standard for resolution.
- 3. If further clarification is needed, a mutually agreed-upon third-party roofing inspector may provide an independent evaluation.
- 4. Both parties shall have full access to any reports or findings issued by the third-party evaluator
Any third-party inspection costs and further dispute resolution procedures will be handled according to the Dispute Resolution provisions of the roofing contract.
What Is Not Covered
This workmanship warranty does not cover
- Defective materials covered by a manufacturer's warranty.
- Hail, wind, fire, flood, lightning, earthquakes, falling objects, ice dams, vandalism, or other severe weather or natural events.
- Movement, deterioration, or failure of the roof deck, framing, sheathing, structure, or other building components.
- Problems caused by improper insulation, ventilation, humidity, condensation, or exhaust venting that were not part of Top That Roofing's work.
- Leaks originating from siding, stucco, windows, chimneys, skylights, HVAC equipment, plumbing, solar equipment, masonry, walls, or other components Top That Roofing did not install or specifically agree to waterproof.
Any alteration, penetration, repair, modification, or disturbance of the roofing system by anyone other than Top That Roofing will void this workmanship warranty unless Top That Roofing provides prior written authorization.
Additional Terms
Workmanship will be evaluated according to the project contract, applicable building codes, the roofing manufacturer's installation requirements in effect at the time of installation, and generally accepted roofing industry standards.
This express workmanship warranty is provided to the original homeowner/buyer and is not transferable.
Nothing in this warranty is intended to waive any right that cannot legally be waived.
Relationship to Roofing Contract
This workmanship warranty is subject to the terms, conditions, exclusions, homeowner responsibilities, and acknowledgments contained in the roofing contract for this project. The roofing contract and this warranty should be read together. If a condition is excluded or identified as the homeowner's responsibility under the roofing contract, issuance of this warranty does not create coverage for that condition.
